Taking Part in a Race on a Public Highway – another Birmingham racing case dropped

BBLaw, were instructed by a total of 8 individual clients, all of whom were being prosecuted for this quite serious offence, which carries an obligatory minimum 12 month disqualification. The allegations all arose from footage recorded by covert CCTV cameras hidden in a set of traffic lights at a pedestrian crossing on the A47 Heartlands Parkway in Nechells, Birmingham. We understand that somewhere in the region of 300 drivers were convicted and each received bans of 12 months or more. Fail to Provide a Specimen of Breath (Drink Drive) – discontinued before trial

BB Law identified a procedural error with the way the intoxilyzer procedure had been conducted in this case. We then made detailed representations to the CPS, which resulted in the case being dropped. An application for costs has now been submitted. This client provided the following feedback –

Disqualification for speeding avoided without client needing to attend court

Excess Alcohol and Fail to Stop charges dropped after BB Law point out police procedural failure

This case went all the way to trial but on the morning of trial the CPS were persuaded to withdraw the fairly serious Drink Driving charge (and also a related Fail to Stop charge) after BB Law point out that the officer had made a procedural error and perhaps more importantly the officer had made inconsistent statements in relation to the issue. The client pleaded guilty to a related Fail to Report offence and walked away with 5 points on his licence, a small fine and a significant proportion of his legal costs refunded.
