S.172 FAIL TO PROVIDE DRIVER INFORMATION – CHARGE DROPPED

This client instructed BB Law a few days before his trial.  We persuaded the prosecution to drop the s.172 charge (which carries a large fine and minimum of 6 points) in return for a guilty plea to the original minor red-light offence.  This was potentially a difficult task because the red-light offence was well over 6 months old and wasn’t included on the original summons.  The client ended up with a small fine and 3 points.  Here is the client’s feedback –

CARELESS DRIVING / FAIL TO STOP & REPORT – CASE DROPPED

BB Law regularly represent clients who are accused of driving off after an accident.  Over the years we have developed a good understanding of how the various police forces throughout the country approach these investigations.  This knowledge helps us to achieve satisfactory outcomes for our clients as quickly as possible.  The following feedback was received from the father of a young female driver who was being investigated by the police for offences of careless driving, failing to stop after an accident and failing to report an accident –

Totting Up’ Disqualification avoided after client instructs BB Law Ltd at the last minute

This client had made a bit of a mess of his case when attempting to represent himself. He subsequently instructed BB Law Ltd days before he was due to be disqualified by Luton Magistrates’ Court. We were able to get the conviction reopened and one of the offences dropped, which meant the client avoided a minimum 6 month Totting Up ban and walked away with a £60 fine, £0 court costs and 3 points! This client received a Notice of Intended Prosecution (NIP) and a requirement to provide driver information (pursuant to s.172 of the Road Traffic Act 1988). Within weeks BB Law Ltd had persuaded the police to drop the whole case. The client provided the following feedback –

142mph Speeding allegation on M6 Toll – 3 month disqualification

This was a long and hard fought case with more aggravating features to contend with than just the high speed. The result achieved was actually more exceptional than the length of the disqualification would suggest. The following feedback was received from this client –

Excess Alcohol and Fail to Stop charges dropped after BB Law point out police procedural failure

This case went all the way to trial but on the morning of trial the CPS were persuaded to withdraw the fairly serious Drink Driving charge (and also a related Fail to Stop charge) after BB Law point out that the officer had made a procedural error and perhaps more importantly the officer had made inconsistent statements in relation to the issue. The client pleaded guilty to a related Fail to Report offence and walked away with 5 points on his licence, a small fine and a significant proportion of his legal costs refunded. North Wales Speeding charge dismissed at trial – Notice of Intended Prosecution held to be defective

This client was facing a minimum 6 month Totting Up disqualification and did not have any grounds to argue Exceptional Hardship, so the pressure was on to win his case. Fortunately, BB Law quickly identified a defect in the police procedure, which resulted in the magistrates dismissing the charge at trial. This is what the client had to say –

Fortunately, for this client his works van had an extremely accurate GPS tracking device and by combining the data from the tracker together with cell site data from our client’s mobile phone provider, we were able to categorically prove that he was not using his mobile whilst driving. This was a case that should never have been prosecuted. The actions of the police officers involved were in our opinion considerably more culpable than the reasonable reaction of this client. Two wrongs don’t make a right but justice was eventually done after a 14 month battle to clear this client’s name. This client was subsequently interviewed by SKY news.

“I contacted BB Law after another specialist motoring solicitor told me I was wasting my time and should just plead guilty. I was convinced I was right and gave Bobby a call. Taking Part in a Race on a Public Highway – another Birmingham racing case dropped

BBLaw, were instructed by a total of 8 individual clients, all of whom were being prosecuted for this quite serious offence, which carries an obligatory minimum 12 month disqualification. The allegations all arose from footage recorded by covert CCTV cameras hidden in a set of traffic lights at a pedestrian crossing on the A47 Heartlands Parkway in Nechells, Birmingham.
